Terms & Conditions

1. General

TURBOVOLT GmbH, Tuchlauben 7A, 1010 Vienna (hereafter „TURBOVOLT”) is the operator of a regional-wide network of fast and ultrafast chargers for electric vehicles, which are accessible by means of authorization via the TURBOVOLT payment website or at the TURBOVOLT payment terminal. These terms of use ("Terms of Use") apply to all contracts between TURBOVOLT and any person using TURBOVOLT’s e-mobility services (“User”) regarding the charging of electric vehicles at electric vehicle charging points operated by TURBOVOLT regardless of whether these contracts are concluded by means of authorization via the TURBOVOLT payment website or at the TURBOVOLT payment terminal. These Terms of Use shall cover allaspects of the contractual relationship between TURBOVOLT and a User. The Users is entitled to use the e-mobility services provided by TURBOVOLT at all charging points operated by TURBOVOLT, subject to their availability (hereafter “TURBOVOLT Network”)

TURBOVOLT has mandated a Croatia based TURBOVOLT subsidiary to issue to the Users invoices for the charging services:

The Users will be receiving invoices from TURBOVOLT Adria d.o.o.

These Terms of Use solely apply for the provision of charging services within the territory of Croatia. The User is entitled to access charging services also outside of Croatia within the TURBOVOLT Network, subject to the acceptance of the TURBOVOLT Terms of Use applicable in the relevant country.

3. Charging Of Electric Vehicle

Authorization of the charging process

TURBOVOLT offers the User two options to authorize and pay for a charging session for an electric vehicle:

  1. TURBOVOLT payment website: The User can scan a QR code that is provided at the charging point, which opens a website where the User can initiate and pay for the charging session without prior registration.
  2. TURBOVOLT payment terminal: The User can initiate and pay for the charging session by using a bank card (credit or debit) at the payment terminal in vicinity of the charging point without prior registration.

Technical requirements

To charge an electric vehicle (fully electric or hybrid) at a TURBOVOLT charging point, the electric vehicle must be equipped with a CCS (Combined Charging System) inlet, a CHAdeMO or Type2 AC inlet.

Parking of the electric vehicle

The User must park the electric vehicle in the indicated area at the charging point.

If use of the car park is not subject to payment of a fee (for example free customer car parks of stores), the User is entitled to park his or her electric vehicle in the car park for the duration of the charging session.  If use of the car park is subject to payment of a parking fee, the user must pay the applicable fee as well as follow any rules or regulations set forth by the car park owner/operator.  As soon as the charging session is completed, the User shall remove the electric vehicle from the charging bay.

Duration of the charging process

The User acknowledges that TURBOVOLT is unable to and does not guarantee a certain duration of the charging session to fully charge the User’s electric vehicle battery, as the duration is dependent on several factors, including the technical specifications of the User’s electric vehicle, the battery charge level (SoC – State of Charge) and the capacity of the specific charger.

Specific rules and instructions for using the charging services

The User shall initiate a charging session only at those TURBOVOLT charging points where the display and optical signals indicate proper operation. If the User discovers defects or external damage to the TURBOVOLT charging point selected by him or her, the User shall refrain from commencing a charging session at the selected TURBOVOLT charging point.

The User may inform the TURBOVOLT customer service under the number indicated at the charging point. The User is obliged to always use the TURBOVOLT charging points with due care and consideration. If the User has caused damage to a TURBOVOLT charging point, the User shall report the damage to the TURBOVOLT customer service under the number indicated at the charging point without undue delay. The User shall follow any safety instructions of the TURBOVOLT customer service.

Instructions for use

The User undertakes to comply with all rules and instructions of TURBOVOLT for use of the charging services. This applies regardless of whether these rules and instructions are attached directly to, or are displayed in the spatial context of the TURBOVOLT charging points or are direct instructions from the TURBOVOLT customer service.  

4. Charging And Payment Via Turbovolt Payment Website

The User may initiate the charging of his or her electric vehicle on the TURBOVOLT payment website by scanning a QR code provided at the charging point. The User may commence the charging session as soon as he/she has accepted these Terms of Use, has selected the location and the charging point on the TURBOVOLT payment website and after successful fund pre-authorization. The charging price is the price stipulated in the price list for Croatia applicable at the time of a charging session. The price list is displayed to the User via the TURBOVOLT payment website (opened by scanning a QR code provided on the charger) before accepting the Terms of Use and authorizing the payment. The price list is also available on the TURBOVOLT website www.turbovolt.energy.

TURBOVOLT Adria d.o.o. will make a fiscal invoice available to the User after the end of the charging session, in which the purchased charging service, the amount of energy transferred, and the charging price, including the legally owed VAT, are set out. The User can access their invoice in two (2) ways:

  1. The User has the option to accesshis invoice(s) by scanning the appropriate QR code, provided on the charger andthe payment terminal, after the end of the charging session. Scanning of the QR code opens the customer portal on the TURBOVOLT payment website where any invoiceis available by entering the last digits of the bank card used for the paymentof the charging session.
  2. Alternatively, the User canvisit the webpage https://www.enio.at/etsweb3/?lang=en&provider=turbovolt and input the date of the charging session and last four digits of the bankcard used for the payment of the charging session to get access to the chargingsession invoice.

5. Charging And Payment Via Turbovolt Payment Terminal

The User may initiate charging of his or her electric vehicle at the payment terminal in the vicinity of a charging point. The charging session is started after accepting these Terms of Use, selecting the charging point on the screen of the payment terminal and tapping a bank card (credit or debit) on the contactless payment device. TURBOVOLT will only enable the User to start a charging session after successful fund pre-authorization. The charging price is the price in the price list for Croatia applicable at the time of a charging session. The price list is displayed to the User via the relevant payment terminal before askingthe user to authorize payment. The User accepts the price by authorizing payment with his bank card. The price list is also available on the TURBOVOLT website www.turbovolt.energy.

TURBOVOLT Adria d.o.o. will make a fiscal invoice available to the User after the end of the charging session viathe relevant payment terminal, in which the purchased charging service, theamount of energy transferred, and the charging price, including the legallyowed VAT, are set out.   2. Alternatively, the User can visit the webpage https://www.enio.at/etsweb3/?lang=en&provider=turbovolt and input the date of the charging session and last four digits of the bankcard used for the payment of the charging session to get access to the charging session invoice.

6. Charging Price

The price of the charging service depends on type and power of the charger, period and time of the charging session. The charging price consists of the amount of electric energy transferred to the electric vehicle (invoiced per kWh), and if applicable, the connector occupancy fee (invoiced as lumpsum) increased by value added tax.  

The charging price can vary according to the type of location, type of charger, type of charging point, charging power and/or day/month/year period due to fluctuations of the energy prices. The User may any time check the price for charging available on the TURBOVOLT website https://www.turbovolt.energy/pricing. The charging price does not include any mobile data costs and transactions fees charged by the User’s bank card issuer.

7. Payment Conditions And Payment Processing

Any charging services purchased by the User via the TURBOVOLT payment website or a payment terminalwill be charged to the User. The charging price for the respective charging sessionis due for payment immediately. TURBOVOLT cooperates with the paymentservice provider First Data GmbH to handle the payment process for the charging services for all payment methods. It is also used for anonymization, virtualization and processing of banking data required for payment transactions. The User accepts that his bank data areprocessed by First Data GmbH for the purpose of processing a payment transaction. The functioning of the services provided by First Data GmbH is described under the link https://www.carat.fiserv.com/en-emea/solutions/payment-methods/. Payments are made in accordance with the payment method chosen by the User. By selecting a payment method, the User confirms that he or she is entitled to dispose of the specified payment means by direct debit. To confirm the existence and validity of the payment method, TURBOVOLT will temporarily block an amount (as indicated and requested for authorization on the payment terminal at the charging point) for fund pre-authorization. The time required for releasing pre-authorized funds is dictated by the User’s debit/credit card issuer.

8. Liability Of User And Turbovolt

TURBOVOLT endeavors to provide an error-free and a high-quality charging service to the User. However, TURBOVOLT does not warrant a specific service quality or the usability of charging points. Further, TURBOVOLT does not warrant that the data is complete, correct and/or upto date. This also applies in particular if a TURBOVOLT charging point is incorrectly marked as functional and/or not in use. TURBOVOLT also does not warrant that the TURBOVOLT charging points and the TURBOVOLT payment website will be available 24 hours a day and reserves the right to carry out updates, maintenance, necessary repairs and other measures to protect Users and/or improve the quality of service, even if this means a temporary suspension of operation or functionality.

10. Applicable Law

All disputes arising from or in connection with the contracts concluded for the purchase of charging services and these Terms of Use are exclusively governed by Croatian law excluding its conflict of laws rules and the CISG. If mandatory standards of the law applicable at the consumer’s habitual place of residence apply and if these are more favorable to the consumer, these take precedence.

11. Final And Other Provisions

The contract for the purchasing of charging services and these Terms of Use form the entire agreement between and exclusively define all obligations of TURBOVOLT and the User.

12. Complaints Handling

The User may file a complaint orally by dialing a hotline +385 1 555 3545 or in writing by sending an e-mail to [email protected]. TURBOVOLTshall respond to a complaint within 15 (fifteen) calendar days by sending a response to the User’s email address.

13. Contact

TURBOVOLT shall sendnotifications or messages to the User’s email address. Notifications and messages sent by TURBOVOLT shall be deemed received by the User immediately following day.
